KISDI Releases Report on 'A Study on Policy Measures for Fair Trade of Audiovisual Media Contents'
- Analyzes the need to introduce a post-compensation system for content authors and the pros and cons of each measure


The Korea Information Society Development Institute (KISDI) has released a report -- KISDI Basic Research (24-03), 'A Study on Policy Measures for Fair Trade of Audiovisual Media Contents: Focusing on Issues Related to Profit Distribution'.
The report discusses the need to introduce a 'post-compensation system' for authors of audiovisual media content (e.g., directors, writers, etc.) and the pros and cons of each measure.
※ The 'post-compensation system' proposes to grant content authors ‘the right to receive compensation afterward' in consideration of the revenues generated from the success of their content even after they have transferred their intellectual property rights to third parties such as audiovisual media content producers or OTT providers.
As the consumption of audiovisual media content has shifted from traditional media to new types of media such as OTT, various issues and controversies are arising in relation to the distribution of revenues between authors of audiovisual media content and IP rights holders (e.g., production companies) and users of IP rights (e.g., broadcasters, OTT platforms, etc.). All relevant experts and stakeholders agree on the basic principle that audiovisual content creators should be fairly compensated, but there is a wide range of viewpoints and positions on the concept of fair compensation and the introduction of a "post-compensation system" for content creators, which is being proposed as one of the concrete ways to achieve fair compensation.
This report presents the results of an opinion survey of copyright experts and media policy experts on the positions of those in favor and against the introduction of a post-compensation system for authors of audiovisual media content. Based on the survey, this report identified the views of copyright experts and media policy experts and their concrete bases on the following: ▲ feasibility of fair compensation through voluntary contracts, ▲ feasibility of fair compensation through collective negotiations with content authors, IPR owners, and IPR user organizations, ▲ possible conflicts between the ‘post-compensation system’ and the special rules for cinematographic works, and ▲ the need for the introduction of the ‘post-compensation system.’
In addition, the report proposed various policy measures to fairly compensate authors of audiovisual media content and analyzed the advantages and disadvantages of each measure. Regarding the introduction of a post-compensation system, the report proposed three options: ▲ maintaining the current system, ▲ post-compensation through collective negotiations, and ▲ introducing a post-compensation system, and analyzed the advantages and disadvantages of each option. In addition, the report examined detailed options that can be utilized if a 'post-compensation system' for content authors is actually introduced on social consensus, such as (1) the subject of post-compensation, (2) the criteria for payment of post-compensation, and (3) the point of determining the details of post-compensation, as well as the advantages and disadvantages of each option.
Research fellow Junseok Kang said, "It is expected that the results of this study will be used as a reference for discussions on improving the system for fair compensation for audiovisual media content creators, and will help lay the institutional foundation for fostering the K-content industry and creating a healthy media ecosystem."
